Axe Throwing Agreement & Liability Waiver

Release of liability, waiver of claims, assumption of risks and indemnity agreement. By initialing and/or signing this document you are waiving certain legal rights, including the right to sue.

I, the undersigned, wish to participate in Red Line Mobile Axe Throwing LLC throwing at my own risk. I am aware that the activity is HAZARDOUS, physically strenuous and involves certain risks, including but not limited to property damage, serious injury, paralysis, permanent disability, loss of limbs resulting from my negligence and/or others, malfunction of equipment, and injuries from throwing instruments (axes, knives, stars, etc.) and/or other participants not using proper safety procedures. Throwing axes could result in permanent injury or death.

I understand there is an inherent risk of injury to myself and others from these factors, the equipment, and other players, and even though the activity is supervised, I am solely responsible for the safety and wellbeing of myself and the minors in my care.

With full understanding of these risks, I wish to participate and hereby assume the risks. I hold Red Line Mobile Axe Throwing LLC (Operator) harmless and indemnify them against any and all claims, actions, suits, costs, expenses (including attorney's fees), damages and liabilities arising out of, connected with, or resulting from axe throwing, including those resulting from the manufacture, selection, delivery, possession, use or operation of such equipment.

I understand it is recommended that I have accidental medical coverage, and agree that if I do not, I will be financially responsible for any charges and fees incurred in rendering treatment.

In case of injury, I authorize Red Line Mobile Axe Throwing LLC staff to render first aid and act for me in an emergency. I waive and release Red Line Mobile Axe Throwing LLC from any and all liability for injuries and illness occurring while participating.

I agree to obey Safety Instructions and Rules and to use the equipment so as not to injure myself or others. My right to participate may be terminated without refund if I fail to follow such Rules.

I accept full responsibility for return of all equipment in good condition or to pay replacement cost upon termination of the game.

I, on behalf of myself, my estate, heirs, executors, administrators and assigns, indemnify the owners of Red Line Mobile Axe Throwing LLC, their suppliers, and their agents, officers and employees from any and all claims, actions, lawsuits, costs, expenses, damages and/or liabilities connected with, or resulting from axe throwing or spectating and from use of equipment or premises, whether resulting from negligence of any party or otherwise. I further agree to indemnify the same parties against any liabilities that may arise between myself and a third party.

I have read and fully understand this "Axe Throwing Agreement and Liability Waiver" and recognize it is a legally binding contract. If I have doubts concerning its content, I will not participate until I obtain legal advice. I certify that I am at least 18 years of age (minors see below) and in good health and do not suffer from a heart condition or other ailments/conditions which could be exacerbated by axe throwing, and I intend to be bound by this agreement.

Photo & Video Release: I irrevocably grant Red Line Mobile Axe Throwing LLC, its successors and partners the right to record my likeness and/or voice on tape, film or digital media, and to edit and incorporate it into video, TV, radio, web or print advertisement or promotions without payment of fees.

CONSENT: I consent to the participation of every participant using and participating in the activity of AXE THROWING, and I am aware the activity is HAZARDOUS and involves the risks described above, which could result in permanent injury or death to myself or any participant at the event I am hosting. By signing this Release of Liability, I represent that I have legal authority over and/or custody of the participants and that each participant was advised the waiver was signed in their name and they waive their rights to the signee of this waiver.
